1. Premise: coincidence between registration on the site and registration in Berignano Club

Berignano S.r.l. He is the owner of the e-commerce website www.berigstore.com ("Site") and is the counterpart of the purchase contracts concluded through the site.

To make purchases through the site, registration on the site is required, which implies activation on the site of a reserved personal area called "My account" ("Registration on the site").
Berignano S.r.l. The promoter of the prize operation called "Berignano Club", ("Operation of Berignano Club" or "Operation"), as regulated by the relative regulation, and of any prizes ("competitions"), as well as, from time to time, governed by the related regulations (the operation and the competitions cumulatively "Berignano" or "Club"), is also.
To take part in the operation and/or competitions, registration on the site is required.
Registration on the site, in turn, entails the registration in Berignano Club, that is, the activation on the site of the confidential areas dedicated to the club through which the logged user has the possibility, if he wishes, to participate in the operation and/or active competitions ("registration in Berignano Club").

Registration on the site and registration in Berignano Club then coincide.

Through the reserved area of the site called "My account", the logged user can carry out, among other things:

- participate in the operation or active competitions (by inserting, for example, the unique codes present in the packaging of the products involved or releasing reviews on the products purchased online);

Through the Berignano S.r.l. He therefore performs a plurality of services ("Site services") and, in particular:

3 Berignano will treat the user's personal data for:
- allow registration to the site and the use of services reserved for registered users, including the possibility of purchasing online through the site;

The data for the purposes and for the maximum periods of conservation referred to in the other sections of this information, if pertinent, and/or, in any case, in the cases established by the regulation and/or by the law.

In particular, in the context of this purpose, Berignano will treat users' personal data, among other things, for:

- allow the user to access the site, also as a non -logged user, and to browse the site;

- allow the user to register on the site, creating an account, and to take advantage of the services reserved for registered users, including, in particular, the possibility of purchasing through the Site, and/or exercising the right of withdrawal online;

- maintain and manage the user's account;

7. Data processing by Berignano for profiling purposes for marketing purposes


With the explicit consent of the user, Berignano will draw the personal data of users, automatedly, for:

- monitor and trace user behavior on the site, collecting and registering the navigation data (e.g. visited pages, products displayed, if the user has purchased or did not buy, abandoned trolleys, access device, permanence time) and purchase data (e.g. type of product purchased, purchasing frequency, spent amounts, payment methods);

- analyze and process these data, together with other information relating to users (such as, for example, genre, cap, date of birth, IP address, played codes, etc.), in order to identify correlations between users' behaviors and insert them in various "clusters" or sets of types of customers who may have common characteristics;

- Send, by e-mail or via SMS, mail or telephone, and/or make the site display on users customized offers, i.e. combined with the cluster in which the user has been inserted and, therefore, of his alleged specific interest.
All the phases of the treatment, including the final decision about the promotional communication to be sent or showed the user on the basis of the or belonging clusters, take place fully automated, without any human intervention, on the basis of an algorithm whose parameters were previously set by Berignano.
The decision based solely on automated treatment, including profiling produces legal effects that concern the interested party (I.E. The limitation of its freedom of choice) and is allowed by the cause of exemption pursuant to art. 22.2.c) of the GDPR, as it is based on the explicit consent of the interested party.

The provision of data for the purpose of profiling for marketing purposes is optional: that is, there is no legal or contractual obligation to provide such data for this purpose and/or to give consent to the processing of your data for this purpose.

The following is reported to the user:

- Users, after their consent, are grouped on the basis of characteristics identified by Berignano and for these reasons included in specific clusters. The clusters are created on the basis of both individual characteristics relating to the site service that users have benefited (e.g. visited pages, products seen, frequency and type of purchases, codes played) and other information relating to users (e.g. genre, age group, used device, cap). The legal basis of this treatment is the execution of pre -contractual measures adopted at the request of the interested party (art. 6.1.b), last paragraph, of the regulation) or, depending on the case, the legitimate interest of Berignano (art. 6.1.f) of the regulation).
It constitutes a legitimate interest of Berignano to respond to requests for information and/or reports and/or disputes and/or complaints of the users of the site and/or participants in the prize operation called "Berignano Club" and/or any competitions from time to time organized by Berignano (to which, however, Berignano is required to respond, also on the basis of the legislation referred to in the Code of Consummer and the Civil Code). This legitimate interest of Berignano also coincides with the legitimate interest of the same users who carry out the requests and/or reports and/or disputes and/or complaints in question and that, therefore, in the context of the relationship with Berignano, it can be believed that they reasonably expect their personal data to be used by Berignano to give them feedback.
The legitimate interest of Berignano, thus identified, can therefore be considered prevalent on the fundamental rights and freedoms of the interested party, also due to these reasonable expectations and the relationship existing between the interested party and Berignano as well as in consideration of the nature of the data processed and the coincident interest of the interested parties themselves.

In the case of exercising the right of opposition to the processing of data for assistance/customer care purposes, Berignano refrains from further processing users' personal data for this purpose, unless he demonstrates the existence of legitimate cognitive reasons to proceed with the processing that prevail on the interests and rights and freedoms of the interested party or for the assessment, exercise or defense of a right in court.
The provision of personal data for the purpose in question is optional: that is, there is no legal and/or contractual communication of data communication; However, given the purpose of the processing, the failure to communicate data and/or the exercise of the right of opposition can make the response to requests and/or reports and/or complaints and/or to the disputes of users impossible, if the response to these requests implies the processing of personal data of the user.

All phases of the treatment, including the decision about the resolution of the purchase contact, in the case of violation of the purchase limits provided for by the CGV, take place completely automated, without any human intervention, on the basis of the rules set by Berignano and explicit in the CGVs that provide for the termination of all contracts concluded without compliance with the purchase limits by the same expected.
The decision based solely on automated treatment, including profiling, produces legal effects concerning the interested party (I.E. The termination of the purchase contract) and is allowed by the cause of exemption pursuant to art. 22.2.A) of the GDPR, as necessary to the execution of the contract between the user and the interested party and/or in any case connected to this contract and its validity and effectiveness.

The user therefore has the right, at any time, of:
- obtain human intervention by Berignano;
- express one's opinion;
- contest the decision taken by Berignano.

For the purpose of preventing the improper use of the site services/verification of compliance with the purchase limits referred to in the CGVs, Berignano will process the personal data of users for 24 months from the collection.

As for the legitimate interest of Berignano, the system and logic used to reach the decision regarding the termination of the purchase contract, the following is reported to the user:

- constitutes legitimate interest of Berignano to carry out an activity, including monitoring, for the purposes of preventing the improper use of its services, aimed, in particular, to verify compliance with the purchase limits established by the CGV in order to avoid the grasping of the products and their illegitimate resale on parallel markets. This legitimate interest of Berignano also coincides with the legitimate interest of the users of the site and, in general, of the community, which in turn have a legitimate interest in ensuring that fraudulent activities are discouraged and identified when they occur; Taking into account the fact that the purchase limits are expressly provided for in the CGV, made available to users of the site through a specific link in the Footer of the Site and that the user must explicitly accept the CGV in order to proceed with the purchase, it can therefore be considered that users, in the context of the relationship with Berignano, reasonably expect their data to be also processed for the purpose of preventing the improper use of the services of the site and, in particular, in particular. verify compliance with the purchase limits established by the CGV, to their own protection and guarantee and which consequently the legitimate interest of Berignano can be considered prevalent on the interests, rights and freedoms of the interested party;

- In the case of exercising the right of opposition, Berignano abstains from further processing users' personal data for this purpose, unless he demonstrates the existence of legitimate bonal reasons to proceed with the processing that prevail on the interests and rights and freedoms of the interested party or for the assessment, exercise or defense of a right in court.

Berignano will treat users' personal data in order to prevent improper use of site services and, in particular, in order to prevent participation in the prize operation called "Berignano Club", as governed by the relative regulation ("operation"), and any competitions from time to time organized by Berignano, as regulated by the related regulations ("competitions"), with fraudulent means and in violation of the normal performance. of the operation or competitions or the rules governing participation in a prize event.
The legal basis of this treatment is the legitimate interest of Berignano (art. 6.1.f) of the regulation).

The treatment is automated, but the final decision, which may entail the exclusion of a user from participation in the operation and/or competitions and/or by the use of the prize possibly attributed to him, takes place through human intervention. Article 22 of the Regulation does not apply.
For the purpose of preventing fraudulent participation in the operation and/or competitions, Berignano will process the personal data of users until the 180th day from the closure of the operation or the individual competition, without prejudice to that, after this term, Berignano will be able to keep the data for the purposes and for the maximum conservation periods referred to in the other sections of this information, if relevant, and/or, in any case, in the cases established by the regulation.

As for Berignano's legitimate interest, the following is reported to the user:

- constitutes legitimate interest of Berignano to carry out an activity for preventing fraudulent participation in the operation and/or competitions. This legitimate interest of Berignano also coincides with the legitimate interest of users of the site, participants in the operation and/or competitions and, in general, of the community, which, in turn, have a legitimate interest in ensuring that fraudulent activities, particularly in the case of prize events, in which the public faith must be protected, are discouraged and identified when they occur; It can therefore be considered that users, in the context of the relationship with Berignano, as a company promoting the operation and competitions, reasonably expect their data to be processed also for the purposes of preventing fraudulent participation in the operation and competitions, in their own protection and guarantee and that consequently the legitimate interest of Berignano can be considered prevalent on the interests, the rights and freedoms of the interested party;

- the provision of data for the purpose in question (I.E. Purpose of preventivenor of fraudulent participation in the operation and/or competitions) is optional: that is, there is no legal or contractual obligation to provide such data for this purpose;

- for this purpose Berignano uses data initially collected for different purposes (e.g. participation in the operation and/or competitions) whose further treatment for the purpose of preventing fraudulent participation in the operation and/or competitions is allowed, as based on the legitimate interest of Berignano, given the compatibility of the purpose in question with the purpose for which the data are initially collected;

- the failure to provide personal data for the purpose in question or the opposition to the use of such data for this purpose will not involve any consequence on the possibility of the user to participate in the operation and/or competitions, without prejudice to the prohibition to participate in one or others in a fraudulent way and/or with violation of the rules on prize events and/or in violation of the normal performance of the operation and/or the competitions, as regulated by the related regulations;

- In the case of exercising the right of opposition, Berignano abstains from further processing users' personal data for this purpose, unless he demonstrates the existence of legitimate bonal reasons to proceed with the processing that prevail on the interests and rights and freedoms of the interested party or for the assessment, exercise or defense of a right in court.

11. Data processing by Berignano for publication purposes on the website of the reviews compiled by users
With the express consent of the user, Berignano will draw the personal data of users in order to publish on the site the reviews that may be left by users in relation to a specific product purchased on the Site. The reviews, if deemed suitable, will be published in the product sheet to which they refer and will therefore be viewed by all users, recorded and not, who surf the site.
The legal basis of this treatment is the express consent of the interested party (art. 6.1.a) of the regulation).
The user may express this consent, in relation to each individual review, by pressing the "Public Review" button present in the appropriate form.

The user may revoke the consent given and/or oppose, at any time, to the processing of his data for the purpose in question and/or request the cancellation of the published review, contacting Berignano at the following contact details:

The provision of the data for the purpose in question is optional: there is no legal or contractual obligation to provide the user to provide such data for this purpose and/or to provide consent to the processing of your personal data for this purpose. The failure to provide data and/or the failure to carry out the consent for the purpose in question, however, will involve the impossibility for the user to see the completed review published on the site. In the event that the user does not want to see his review published on the site, he will have to refrain from clicking on the "Public Review" button.

Berignano will treat users' data for the purpose of executing administrative and/or accounting and/or tax obligations, connected to the provision of the services of the site and/or the purchase contract concluded through the site, such as, by way of example, the holding of the accounting records and the issue of the sales invoice or, depending on the case, connected to the registration to the site and/or the performance of the operation called "Berignano Club" of any competitions to organized prizes from time to time by Berignano, such as, by way of example,The obligations referred to in Presidential Decree 430/2001.
The legal basis of this treatment is the fulfillment of legal obligations to which Berignano (art. 6.1.c) of the regulation is subject).
The provision of data for the purpose in question is mandatory, because their processing is necessary to allow Berignano to fulfill legal obligations on the same. Any refusal to provide the data for this purpose will result in the user for the user to take advantage of the Site services and, in particular, to conclude the purchase contract through the Site or, depending on the case, the impossibility for the user to register on the Site and/or to participate in the prize operation called "Berignano Club" and/or any competitions to prizes organized from time to time by Berignano.
For this purpose, Berignano will deal with the user's data up to the expiry of the terms of the law provided for the carrying out of each administrative-accounting and fiscal fulfillment and/or for the conservation times provided by the law for the conservation of the relative documentation.

13. Data processing by Berignano in order to allow the user to exercise rights
Berignano will treat user data in order to:

- give back to requests for exercising the right of withdrawal and/or requests for the exercise of the legal guarantee of conformity and/or other rights born from the purchase contract concluded on the site and/or provided by the law in relation to this contract and/or in relation to the provision of the services of the site;

- give back to requests for the exercise of rights deriving from registration on the site and from the participation in the prize operation called "Berignano Club" and/or any competitions to organized prizes from time to time by Berignano;

- carry out the activities that prove to be necessary as a consequence of the exercise of these rights and proceed, if necessary, to the relative reimbursements;

- receive and refunds to the requests for exercising the rights on the protection of personal data provided for by the regulation and carry out all the consequent activities.

Berignano will treat user data for the assessment, exercise or defense of a right in all the competent offices.
The legal basis of this treatment is the legitimate interest (art. 6.1.f) of the regulation.
Constitutes a legitimate interest of the data controller to carry out means of appeal to guarantee compliance with his contractual rights or demonstrate that he has fulfilled the obligations born from the contract with the interested party including the promise to the public referred to in the regulation of a prize event, or imposed on the data controller. This legitimate interest finds, in turn, foundation, in the right to constitutionally protected defense. It can therefore be considered prevalent on the fundamental rights and freedoms of the interested party, also due to the reasonable expectations of the same.

a) for proof of the fulfillment of the for the purposes of proving fulfillment of the purchase contract through the site and/or provision of the services of the site and/or to start or respond to actions relating to this contract and/or to this service before any administrative and/or jurisdictional authorities and/or to protect their rights in the preparatory phases of the judgment and/or the procedure; For this purpose, the data will be kept for 10 years by the delivery of the product and/or by the provision of the services of the Site, including the registration service (in this case the data will be kept for 10 years starting from the closure of the account) or by the termination of the contract, in the event of non -delivery of the product;

c) to prove that it has allowed the exercise of the rights provided by the prize operation called "Berignano Club" and/or by individual competitions from time to time organized by Berignano and/or by the purchase contract on the site and/or by the regulation and/or by the law (e.g. right of withdrawal or legal guarantee, in the case of purchase through the site) and having made the provisions of the law and/or by the contract (e.g. reimbursement of the right of the right of the right);

d) to try to have given back to the complaints and/or reports and/or the disputes of users;

e) in the case of exercising the rights provided for by the Regulation, the data will be kept for 5 years starting from the attestation to have given a response to the request for the interested party or by this feedback, if subsequent;

f) in the case of exercise of rights provided for in the purchase contract or by the law, the data will be kept for 10 years, starting from the closure of the practice or by the execution of the action that defines it (e.g. refund, in the event of withdrawal; or delivery of the replacement product, in the event of a legal guarantee); By closure of the practice we mean the last correspondence relating to the exercise of the law in question;

g) In the case of complaints and/or reports and/or disputes, the data will be kept for three years from the closure of the practice, to be understood as the last correspondence on the matter.

It should also be noted that:

- The provision of data for this purpose is optional: there is no legal or contractual obligation that requires the interested party to provide the data for this purpose;

- For the purpose in question, data collected are used initially for a different purpose, whose further processing is allowed as it is based on the legitimate interest of the owner, given the compatibility of this further purpose with the initial purpose of the collection, also taking into account the fact that, to the extent that the treatment is necessary for the assessment, exercise and defense of a right, the data controller is also, which is also exempted from the express provision of the regulation;

- In the case of exercising the right of opposition, in fact, the data controller refrains from further processing personal data, unless he demonstrates the existence of binding reasons to proceed with the processing that prevail over the interests, rights and fundamental freedoms of the interested party or for the ascertainment, exercise or defense of a right in judicial.
15. Treatment by Berignano of health data

For registration on the site, for registration in the club, for the purchase of the products offered for sale on the Site and/or for participation in the prize operation called "Berignano Club" and/or for participation in any competitions in organized prizes from time to time by Berignano, the provision of data relating to health is not required.
It may happen, however, that, given the type of products subject to sale through the Site, in the case of exercise by the user of the legal guarantee of conformity and/or reports, disputes or complaints by users and relating to the products purchased on the Site, Berignano may process data which, based on art. 4.15) of the regulation, can be considered as "health data", as they can derive from them, too Indirectly, the state of health of a natural person or information relating to his health may be less than.
These data will be processed only in order to execute the user's request and only and exclusively subject to explicit and specific consent of the interested party, which the user will be requested once the user's request containing such data will be received and before the further treatment of the same.
The legal basis of this treatment is the explicit consent of the interested party (art. 9.2.a) of the regulation).
The provision of health data is optional: there is no legal or contract obligation that provides for the user the obligation to provide such data. The provision of consent to the processing of such data is also optional. However, given the purpose of the processing (I.E. allow the request to the requests of the interested party and/or to the exercise of rights by the interested party), in the event of failure to provide such data and/or failure to provide consent to the processing of health data, the user will not be able to obtain refunds for the request, also for the exercise of a right, carried out. In the event of non -performance of the consent to the processing of health data, the data relating to the health provided by the interested party will be immediately deleted.
